I AM fully of Opinion, that the charge in the Plaint, is not proved. 1st. BECAUSE it appears to me that there is no proof either positive, or Circumstantial, that Mrs. Grand knew of, or previously consented to his Mr. Francis coming for any purpose, much less for the purpose of Adultery. 2d. Because there is no proof either direct, or founded on violent presumption, that they were actually together; much less was there any proof that they committed any crime together. 3d. Because the evidence appears to me to fall short of what is ordinarily considered as proof of any Fact, and especially of any Crime. 4th. Because it falls exceedingly short of what our Cannon Law Considers as proof of Adultery. And Lastly because I've never read or heard of any action for Crim Con. In which a Verdict has been given for the Plaintiff, on such Presumptions, of Guilt. N. B. Sir ROBERT CHAMBERS held the distinguished Post of Vinerian Professor at Oxford when he was appointed a Judge at the Supreme Court, and Sir ELIJAH IMPEY was Council on the side of his Royal Highness the Duke of Cumberland, and Lady Grosvenor in that memorable Crim. Con. affair. HUDIBRASS observes. What shall we say when Doctors disagree, And soundest Casuists doubt like you and me. In Legislation HELIOGABALUS, tho' a sad Dog instituted one very favourable and just Law, which was the establishing a Female Jurisdiction, to sit in judgment upon all Tryals relative to the Sex. I think that such a supplement is much wanted in our constitution, how can a Female Culprit be said tried by her Peers without a Female Jury? Upon all Indictments for Ravishment particularly, Women only should be Impannelled.——For the Business upon such occasions, ought undoubtedly to be rather to Examine the Accuser, than the Accused, Women must most certainly be the best Judges in these Mysteries of the BONA DEA, and can quicker discover whether the Testimony arise from a spirit of chastity, of EXTORTION, or extenuation of the Jurors own frailty, and a Man ought only to be condemned upon the first category. A Paragraph Extraordinary. SOME Gentlemen of high Ton in Calcutta, have form'd themselves into a select Party for practising Cotillions, and other polite amusements.—These Elegant young Men have very modestly distinguish'd Themselves with the Title of the COMMUNITY.—They assemble twice a Week at each others Houses, to Rehearse New Dances, and form Rules for regulating the TON, and correcting that GROSSIVE of manners which has too long prevailed in the Public Assembly's of BENGAL. PIGDANNY DURGEE Esq; an Appendage of the Hon'ble B—— of T—— Officiates as the Sir Clement Cotterell. In humble imitation of their betters several COUNTRY CAPTAINS, and an equal number of Accomplished Ladies of the BLACK and BLUE Squadron, have established a Hop on a similar plan, called The ACADEMY OF GROWN GENTLEMEN TAUGHT TO DANCE. One very excellent regulation of this Assembly is, whoever introduces an Attorney, shall be fined a Rupee, and the Lawyer toss'd in a Blanket. Bona Money-bag Esq; a very eminent Practitioner, was refused admittance at the last Assembly. tho' he came dressed in all the colours of the Rainbow and was pronounced able to walk a minuet out of hand, having been one of Monf. Belvere's earliest Scholors. THE BENGAL ESCALAPIAD DRAMATIS PERSONÆ. DOCTORES. } KILL CRANNY, SANGRADO, SQUIRT, PHLEBOS, and SCROTUM. SOME Doctors in India would make Plato smile. If you fracture your Skull, the pronounce it the bile, And with terrific Phyz, and a Stare most Sagacious, Give a Horse ball of Jallap, and pills Saponacious. A sprain in your toe, or an Aguish shiver, The faculty here call a touch of the liver, And with ointment Mercurii, and pills Calomeli; They reduce all the bones in your Skin to a Jelly. A fall from your Horse, or Rheumatic mishap, Kill Cranny pronounces, a P——x or a C——p. If you get a black eye, oh Sadder, and Sadder, He swears it proceeds from the stone in your Bladder. In their knowledge of Science, so great is the chasm, That a Fistula sore, they mistake for a Spasm, Broke down by the climate, low weak 'tw'd surprize you, To hear them insist that your Blood is too Sizey. If a compound of ills, from such treatment you boast, The plan next advised, is a trip to the Coast, With a shrugg of concern Galen, shakes you off easily And sends you to pester the f'm'd Doctor Paisley, You may pine on the Coast 'till your money's all spent, And then you return full as well, as you went. Another sage practice, to startle, or pain us Is in mild Diarrheas, to stop up the A—n—s Transform the Flux, to a cramp in the Bowels Like the fam'd Doctor last, you'r then ply'd with hot Towels, The Patient roars out, with a horrible cholic, But the Doctor goes on with Medical frolic. Till finally fear'd by the sinking pulsation, Finds his blunder conclude, in a mortification. Decend Esculapius thou Mortal Divine, And dispatch to perdition, those medical swine. Such Doctors who never saw Leyden, or Flanders, Run counter to reason, and bleed in the jaundice. If your Wife has a Head-ach, let Sangrado but touch Her, And he'll jabb in his Launcet like any hog Butcher. Tho' in putrid complaints, dissolution is rapid, He'll bleed you to render the serum more vapid. Against such a system, the Colledge may Preach, Still Sangrado bleeds on, like a human Horse Leach. And as if predesign'd by a regular Plan sett, To the Shades we're dispatch'd, by a touch of his Launcet. Despising all Rules of the famed Parracelsus, Sangrado at once by the Lord Harry snails us.

The Calcutta DIABOLIAD or a Poetical Charicatura of the whole legat Squadron by the same Author will shortly appear. The following News was received on Saturday last, but came too late for insertion. Extract of a Letter from Madras. MR. TURING has informed a Correspondent in Town, that the Captain of a small Salt Vessel has sworn before him, that on the 28th Ult. he left Madras, three days before he weighed, he heard a Salute of 21 Guns fir'd from the Fort. On enquiry of some Vesse's in the Road, he was informed, that a great Victory had been obtained over Tippy Sahib.—The next Day a second Salute was fired, the cause of this was the Entrance of Tippy Sahib, Hyder Ally's Son a Prisoner under charge of an European Granadier Company into Fort St. George. He further adds that the very next Day Eight line of Battle Ships, and six frigates, under French Colours appeared, the Fleet stood on, and off till next Day, when they stood to the Norward.—He adds also, that the following day five large Ships appeared which prov'd to be English, and are conjectured to be the fleet that convoyed Sir Tho's Rumbold home, and his small and Hon'ble Fortune.—It happened that these Vessels were chased, and come up with by a French Frigate, who examin'd the Captain relative to the state of Fort St. George, and after receiving all the Intelligence he could give he was dismissed. Mr. Turing further informs his Correspondent that a second small Country Ship was arrived, and that the Commander confirmed the foregoing Intelligence. On the 17th Sir Eyre Coote marched from the Mount towards Chingleput with about 8000 of the Company's and Nabob's Troops, and about 2500 Cosseries, who had been sent in by the Poligars. At this time the main body of Hyders Army was at Arcot and vellore, and the latter place was besiged. It was gallently defended by Col. Lang, who by the sallies which he had made, had rendered abortive all the enemy's attempts to carry on a regular Siege; and who in his last sally, had destroyed a Battery of 4 Guns, before they had time to make any use of it. The discovered treachery of the Kelledar of the Fort, had obliged, Col. Lang to confine, him and in consequence of this all the principal Officers who had been taken prisoners, in the brave Col. Baillie's unfortunate engagement, had been loaded with Irons by Hyder. Authentic accounts are received, that Carangooly was taken by storm on the 21st. Inst. by the very gallant behaviour of Capt. John Davies, and the Party under his Command; and, on the 24th Sir Eyre Coote, was so fortunate as to relieve Wandewash. It is worthy of remark that this has happened on the day, on which he had before relieved this Place 21 years ago, by a battle with the French. The French Squadron which appeared off Madras on the 26 Inst. consisted of 5 Ships of the Line, two Frigates and a Sloop, is Commanded by Mons. D'Orves. It left Mauritius on the 9th of October. The accounts which have been received, and which may be depended on, mention that the French Land Forces were detained at the Islands, to guard them against an expected attack from the English; and it was said also, that the Squadron was to quit the Coast, about the middle of February. As yet they have had no other success, than the capture of the Snow Speedwell, which had been since ransomed for 80 Days, for 10,000 Rupees; and of the Tannah Schooner. The Squadron is gone to the Southward. Affairs at Madras were in perfect security, and tranquility, when the Letters came away; the Grain was landing with all possible expedition, and it was not doubted that the high prices given for all articles of Provisions, would encourage Importers to exert themselves at sending round Cargoes from the Northward speedily. At the time when the French Squadron appeared off Madras, there were in the Roads 5 Indiamen, which left England on the 3d of June. Their names are, the Neptune, Dartmouth, Bellmount, Grosvenor, and Rochford: These ships bring advices of the death of Admiral Hardy, who had been succeeded by Admiral Geary in the command of the Fleet, then consisting of 38 Sail of the Line. The French Fleet had sailed from Brest, when the Indiamen left England; and the Spanish Fleet were ready in Port, but ready for sailing. Guichen with 17 Ships of the line (the flower of the French, Navy) sailed to the West Indies, in consequence of which, a Frigate was dispatched after Sir George Rodney, with Orders for his immediate Sailing for the West Indies, in order to prevent Guichen from attempting any thing against our Settlements there. Sir George Rodney has been very successful against both the Spanish and French in many capital Engagements he has had with them, since his arrival in the West Indies. N. B. The Removal of two obnoxious Franciscans, was the object of this famous Embassy, which has occasioned so much speculation in the settlement. ANTI SQUIB. Mess. HUGGINS and O'DONNELL. RESPECTFULLY Beg leave to inform the Ladies, and Gentlemen of the Presidency, and of the several subordinate stations, that they have opened a new Ware-house to the Southward of the great Tank for the sale of all kinds of Europe and China Articles, of the first Quality, and on the most moderate Terms' That all Orders and Commissions from the Country shall be punctually, and attentively complied with, and that they will receive back any things not approved of on their arrival, (Claret, Porter, and Teas excepted, which are liable to Damage from the smallest inattention;) They would therefore wish that the Attorney at Calcutta of any Gentleman who favors them with their Commands, may see, and taste the latter Articles, before they are embarked, and reject them if not good. [Column 4] BENJAMIN WHITEHEAD. WHO formerly kept a School in Calcutta, takes this method of acquainting the Public, that he has lately returned from Habeeb Gunge, with an Intention of going to Europe, but having been disappointed, he has taken a place in the Country, agreeably situated in a good air, on the right hand side of the great Road, beyond Chitpore Bridge, opposite the Avenue which leads to the Nabobs Garden, where he proposes keeping an English Boarding School, for young Gentlemen, where Youth may be Boarded, lodged, and educated, in Reading, Writing, and Arithmetick, and taught in a plain easy, and expeditious manner, to speak, and write English Correctly, on the following terms. Viz. those that eat at his own Table, at 50 S. R. per Month, and those that eat at a seperate Table, in the School at 30 S. R. per Month, he intends not to take in more than 14 Scholars, unless he gets an Assistant, as he thinks that number to be as many as one person alone can duely attend, and do justice to their Education. As he intends to study to promote the quick Improvement of his Pupils, he hopes through his Care and Diligence, to give entire satisfaction, to those who shall favour him with their encouragement. Mr. Hicky begs leave to acquaint his Correspondents, that he has been obliged to leave out several Advertisements, and the Acknowledgements and Arrivals this Week for want of room.

Calcutta February 10th, 1781. Mr. ROBERT RISHTON. BEGS leave to acquaint the Gentlemen of the settlement, that at the desire of his Friends. He has opened a Tavern in the Radda Baazar, next to Mr. Fivey's Europe shop, where he hopes for the further continuance of their favours, He also embraces this Opportunity of expressing his thanks to the Public in general, for the favours and countenance He has met with, and to assure them, that it will be his principal study to give satisfaction to those who may be pleased to continue their favours. N. B. Oysters every Week. To be SOLD. A Handsome neat Charriot compleatly fitted up for further particulars enquire of Messrs. Simpson and Mitchell Coach Makers near Mr. D cre's House. ALL PERSONS. WHO have any legal claims or demands on the Estate of Mr. Andrew Hiernle deceased formerly inteatums Chief of the Danish settlement, at Fredericlnagore in Bengal and his surviving Widow, are hereby requested to send in their Respective claims and all Persons indebted to the said Estate, are desired to pay their respective Debts to Mr. J. Borgen Judge of the inferior Court of Judicature at Tranquabar, and Administrator of the Estate and Effects of the said Mr. Andrew Hiernle deceased, on or before the Expiration of a Year and a Day from this Date the 19th August 1780. ALL PERSONS. WHO have any demands on the Estate of the late Lt. Colonel Upton, are desired to send in their demands, and all persons indebted to the said Estate, are requested to pay their respective debts, to John Murray Esq; Executor of the said Estate, on or before the first of April next. As He is a stranger in the Settlement, and obliged to leave it in a short time, He flatters himself, the Ladies, and Gentlemen will not be displeased at His requesting Ready Money, and Sicca Rupees.
